AI Terms

Effective as of September 10, 2025

These Litvue AI Terms (these “terms”) are between Litvue, Inc. (“Litvue”) and the customer agreeing to these terms (“you”). If you are agreeing to these terms on behalf of a company (such as your employer) or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these terms. In that case, “you” refers to that company or other legal entity. These terms are expressly incorporated into your existing Software Services Agreement with Litvue (your “Customer Agreement”). These terms will govern if they conflict with any of the other terms in your Customer Agreement.

1. Access to Litvue AI

Litvue AI is made available to you on the terms and conditions that apply to the Litvue Platform in your Customer Agreement. Just like when you use the Litvue Platform generally, you are responsible for using Litvue AI in accordance with your Customer Agreement. “Litvue AI” means feature(s) and functionality made available by Litvue that are identified by Litvue as artificial intelligence (“AI”) features.

2. Input, Output, and Ownership

You may provide or make available prompts, images, materials, files, and other content to Litvue AI (“Input”), and receive images, materials, files, and other content generated and returned by Litvue AI based on that Input (“Output”). Input and Output are Customer Data. As between you and Litvue, you retain all right, title, and interest in your Input and Output, and Litvue retains all right, title, and interest in the Litvue Platform (including improvements and enhancements to the Litvue Platform, along with new products and features). “Customer Data” means the applications and materials that you develop on or upload to the Litvue Platform.

3. Training Litvue AI

Unless you provide express written permission, Litvue will not use your Customer Data to maintain, improve, and enhance Litvue’s products and services by training machine learning and artificial intelligence algorithms and models.

4. AI Limitations

Output is generated by AI. Output is not verified by Litvue for accuracy and does not represent Litvue’s views. Litvue makes no warranty or guarantee as to the accuracy, completeness, or reliability of Output and will in no way be liable or responsible for your use of Output or any omissions or errors in Output. You are responsible for evaluating Output for accuracy and suitability for your use case, including by employing human review of Output and obtaining any relevant clearances.

Further, Litvue makes no warranty or guarantee that the Input or Output are automatically covered by any particular jurisdiction’s evidentiary rules pertaining to the attorney-client or work-product privileges. This area of the law is developing and Litvue hopes and suspects that both the Input and Output of our Services will be covered by the attorney work-product privilege in most if not all jurisdictions in the United States. However, for the purpose of removing all doubt, Litvue reiterates that it makes no representation that this will be the case in any given jurisdiction within the United States or any of the Supported Countries and Territories.

5. Miscellaneous

Litvue may update these terms in the same manner that Litvue may update your Customer Agreement. Any capitalized terms that are used but not defined in these terms will have the meaning given to those terms in your Customer Agreement.
